The lawyers in our False Claims Act Practice Group provide consultation and representation for all types of businesses and commercial endeavors subject to the False Claims Act (“FCA” or the “Act”). This includes advising and guiding clients subject to requests for information and investigations, negotiating with the Department of Justice and United States Attorney offices, and representing clients in federal court when claims are filed by the Government or by qui tam plaintiffs on behalf of the Government.

Understanding the FCA

The federal FCA, codified at 31 U.S.C. §§ 3729 et seq., stretches across a variety of industries, such as the health care industry, the defense industry, the cyber security industry, and any industry or entity that contracts with or is funded by the federal government or federally-funded programs (e.g., Medicare or Medicaid). The Act makes it illegal for anyone to knowingly make a false claim, statement, or certification regarding a federal contract or a federally-funded program, regardless of whether payment is actually approved or made. Violations of the Act may result in monetary penalties, treble damages, debarment, and federally-monitored compliance plans that can be debilitating for any client subject to them. It is important for clients to contact counsel who are experienced and proficient in handling FCA matters at the earliest suspicion that the FCA may apply to any of the client’s transactions so that proper guidance, representation, and, if necessary, defense can be provided.
