The lawyers in our Probate Litigation Practice Group represent heirs, beneficiaries, family members, personal representatives, trustees, creditors, and other interested parties in all types of probate-related disputes. These disputes frequently involve unique legal and family dynamics and present unique legal and practical challenges. And while we forcefully advocate for our clients’ interests, we try to do so in a way, if possible, that does not lead to lingering hostility or feelings of ill-will among family members.  

Probate Litigation Counsel for Will Contests, Creditor Claims and Other Disputes

Our lawyers represent clients in probate litigation in state and federal courts throughout Alabama, Florida and the rest of the United States. In addition to handling disputes arising in the court that is administering probate, we also regularly represent clients in disputes involving real estate and other assets that are located across state lines. When serving as counsel for personal representatives or trustees, we work closely with our clients to ensure that they have a clear understanding of their legal duties and the options they have available. When representing beneficiaries, we walk with them through the process to make sure that their rights and interests are protected.  And, when representing estate creditors, we utilize the applicable law to ensure that our clients are able to collect as much of their outstanding debts as possible.

Within our probate litigation practice, we handle all types of probate-related disputes. This includes, but is by no means limited to:

  • Conservatorships and Guardianships
  • Creditor claims
  • Disputes involving the distribution of estate assets
  • Disputes between heirs and beneficiaries
  • Efforts to replace personal representatives
  • Incapacity claims
  • Intestate estate litigation
  • Personal representative and trustee breach of fiduciary duty claims
  • Undue influence and duress claims
  • Will contests

In addition to representing clients in probate litigation, we provide legal representation for disputes arising out of the administration of revocable and revocable trusts as well. Probate and trust litigation often (though not always) go hand-in-hand; and, in many cases, resolving probate and trust-related disputes requires a coordinated and all-encompassing approach. As litigation counsel, we work to resolve our clients’ disputes as efficiently as possible (and as amicably as possible when possible); and, while our lawyers are skilled courtroom advocates who do not shy away from taking cases to trial, we focus on negotiating out-of-court settlements whenever it is in our clients’ best interests to do so.
